Gang of hypocrites -1

Chapter Nuur” – (Light) - 24

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.
 (I seek refuge in Allaah from Satan the outcast)

Bis-Millaahir-Rah-maanir-Rahiim.

(In the name of Allaah, the Beneficent, the Merciful)

 إِنَّ ٱلَّذِينَ جَآءُو بِٱلْإِفْكِ عُصْبَةٌ مِّنكُمْ لَا تَحْسَبُوهُ شَرًّا لَّكُم بَلْ هُوَ خَيْرٌ لَّكُمْ لِكُلِّ ٱمْرِئٍ مِّنْهُم مَّا ٱكْتَسَبَ مِنَ ٱلْإِثْمِ وَٱلَّذِى تَوَلَّىٰ كِبْرَهُۥ مِنْهُمْ لَهُۥ عَذَابٌ عَظِيمٌ 11  

11.  Lo! they who spread the slander are a gang among you. Deem it not a bad thing for you; nay, it is good for you. Unto every man of them (will be paid) that which he hath earned of the sin; and as for him among them who had the greater share therein, his will be an awful doom.
11.  ‘Innallaziina  jaaa-‘uu  bil-‘ifki  ‘usbatum-minkum.  Laa  tahsabuuhu  sharral-lakum.  Bal  huwa  khayrul-lakum.  Li-kul-lim-ri-‘im-minhum  mak-tasaba  minal-‘ism.  Wallazii  tawallaa  kibrahuu  minhum  lahuu  ‘Azaabun- ‘aziim.

Commentary

‘Ifkun – (slander, a false or malicious report), here it aims; that groundless talk which came out from the tongue of Abdullah bin ‘Ubaii {who was Chieftain of Hypocrites in Madinah and serious enemy of Allaah’s Messenger (grace, glory, blessings and peace be upon him)}.

During the sixth year after Hijrat (Muslim era), the Messenger (grace, glory, blessings and peace be upon him) was coming back from the Battle of Bani Mastalaq along with the Army of the Muslims. Aaishah Siddiqah (may Allah be pleased with her) was accompanying also. And she used to ride alone on the covered litter of a camel separately. During journey the Army halted at a place and the litter was dismounted from the camel as usual and placed at the ground separately. After a while, She (may Allah be pleased with her) felt necessity of going to the privy, so after coming out from the litter she went into jungle. It was night hour. Thread of Her necklace broke and its beads were dispersed. It took some time in search of the beads and the caravan moved away. Care-taker of her camel loaded the covered litter on the camel because he took that Aaishah (may Allah be pleased with her) would have been in the litter. Therefore he marched up along with the caravan.   

When Aaishah (may Allah be pleased with her) returned from the jungle, she saw that the caravan had gone forth. She stayed at the spot with patience that haply someone will come in search of her. She went to sleep because it was night time. A while later, Safwaan bin Ma’-til (may Allah be pleased with him) who used to travel behind the caravan so that if anything had been left behind; might be picked up, reached there in the morning and saw that a person was sleeping alone. He recited
انا لله وانا اليه راجعون
(To Allaah we belong and to Allaah we will return) because he was confused that someone had died.

Aaishah (may Allah be pleased with her) awoke and Safwaan bin Ma’-til (may Allah be pleased with him) recognized her, caused to sit his camel down and She rode on the camel, but he caught the string of the camel (the wooden or iron instrument fixed to the camel’s nose to which is tied the string by which it is led) and walked himself on foot. They (both) reached the caravan in the afternoon.

If wife bears witness before Allah -2

 وَيَدْرَؤُا۟عَنْهَا ٱلْعَذَابَ أَن تَشْهَدَ أَرْبَعَ شَهَٰدَٰتٍۭ بِٱللَّهِ إِنَّهُۥ لَمِنَ ٱلْكَٰذِبِينَ 8  
وَٱلْخَٰمِسَةَ أَنَّ غَضَبَ ٱللَّهِ عَلَيْهَآ إِن كَانَ مِنَ ٱلصَّٰدِقِينَ 9  وَلَوْلَا فَضْلُ ٱللَّهِ عَلَيْكُمْ وَرَحْمَتُهُۥ وَأَنَّ ٱللَّهَ تَوَّابٌ حَكِيمٌ 10

8b.  that the thing he saith is indeed false –

9.  And a fifth (time) that the wrath of Allah be upon her if he speaketh truth.

10.  And had it not been for the Grace of Allah and His mercy unto you, and that Allah is Clement, Wise, (ye had been undone).
8b.  ‘Innahuu  la-minal-  kaazibiin.

9.  Wal-khaamisata  ‘anna  gazabAllaahi  ‘alayhaaa  ‘in-  kaana  minas-saadiqiin.

10.  Wa  law  laa  fazlUllaahi  ‘alay-kum  wa  rahmatuHuu  wa  ‘annAllaaha  Tawwaabun  Hakiim.
(Section 1)

Commentary

After saying the determined words of Li-‘aan by the husband, it will be ordered to the woman that if she desires to be saved then she should swear by Allaah saying four times that certainly this man (her husband) is a liar. And at fifth time she should say that if this man speaks truth in this matter then the wrath of Allaah be upon her. If the woman denies from saying these words; then she will be imprisoned and compelled that either she should say these words or accept it clearly that the man is true in his claim. If she said that the man spoke truth then she would be accused of adultery, punishment of which is stoning to death. It has been explained earlier.

If the woman said the same fixed words which the man said, then Law of Li-aan would be dismissed and now that woman has become unlawful for her husband and cannot dwell with him as his wife. If the husband divorced the woman then the dispute is over, otherwise the Judge (Ruler) will separate them and this separation will be considered as Talaaqul Baa-‘in (Irrevocable Divorce).

After that it is commanded: Commandment of Li-‘aan is the Grace of Allaah Almighty and His mercy, otherwise either the husband would be accused of Qazf and punished according to that Law because he could not bring four reliable witnesses or he would have to remain silent and bear quietly and patiently during his entire life. Due to this reason, by the means of the Law of Li-aan, husband and wife (both) escaped. On one side the man was saved from the punishment of Qazf, and on the other side the woman kept her secret and was saved from the punishment. Now whoever of both of them is really a liar, he/she is wrongdoer. He/she should repent and pray from Allaah Almighty.  

Allaah Almighty is Clement, Knower of all things and Wise concerning all matters.

َٱلَّذِينَ يَرْمُونَ أَزْوَٰجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَآءُ إِلَّآ أَنفُسُهُمْ فَشَهَٰدَةُ أَحَدِهِمْ أَرْبَعُ شَهَٰدَٰتٍۭ بِٱللَّهِ إِنَّهُۥ لَمِنَ ٱلصَّٰدِقِينَ 6  
وَٱلْخَٰمِسَةُ أَنَّ لَعْنَتَ ٱللَّهِ عَلَيْهِ إِن كَانَ مِنَ ٱلْكَٰذِبِينَ 7  وَيَدْرَؤُا۟عَنْهَا ٱلْعَذَابَ أَن تَشْهَدَ أَرْبَعَ شَهَٰدَٰتٍۭ بِٱللَّهِ إِنَّهُۥ لَمِنَ ٱلْكَٰذِبِينَ 8  

6b.  let the testimony of one of them be four testimonies, (swearing) by Allah that he is of those who speak the truth.

7. And yet a fifth, invoking the curse of Allah on him if he is of those who lie.

8a.  And it shall avert the punishment from her if she bear witness before Allah four times
6b.  fa-shahaadatu  ‘ahadihim  ‘arba-‘u  shahaadaatim-Billaahi;  ‘innaHuu  laminas-Saadiqiin.

7. Wal-  khaamisatu  ‘anna  la’-natAllaahi  ‘alayhi  ‘in-  kaana  minal- kaazibiin.

8a. Wa  yadra-‘u  ‘anhal-‘azaaba  ‘an-  tash-hada  ‘arba-‘a  shahaa-daatim-Billaahi,

Commentary

Yadra-‘u – (it shall avert, it shall remove), origin of this word is dar-‘un, which means “to remove, to repel”, that is to say, if the woman gives testimony four times, it will avert the punishment from her.

The husband who accuses his wife of adultery and is unable to prove his claim by four witnesses, he will be asked to say before the court four times clearly that “I swear by Allaah that in this matter, that is to say; in accusing own wife, I speak the truth. I do not tell a lie”. By repeating these words four times, it will be considered that this testimony is of four men. After that, at fifth time, he would have to say, “The curse of Allah on me if I am of those who lie”. If the husband denies from saying above mentioned prescribed words, then he will be imprisoned, and he will not be released until he says these words or accepts that he is a liar. If he accepts that he told a lie, then punishment of Qazf i.e. scourging with eighty stripes will be given to him.

If the man said above mentioned words then the woman will be directed to say four times those words, which have been recorded in the next part of the verse 8(b). If the woman denies saying those words or accepts that her husband spoke the truth, then she will be punished by stoning to death (Rajam).

Form of forgiveness for the liars

Chapter Nuur” – (Light) - 24

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.

(In the name of Allaah, the Beneficent, the Merciful)

إِلَّا ٱلَّذِينَ تَابُوا۟ مِنۢ بَعْدِ ذَٰلِكَ وَأَصْلَحُوا۟ فَإِنَّ ٱللَّهَ غَفُورٌ رَّحِيمٌ 5 وَٱلَّذِينَ يَرْمُونَ أَزْوَٰجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَآءُ إِلَّآ أَنفُسُهُمْ فَشَهَٰدَةُ أَحَدِهِمْ أَرْبَعُ شَهَٰدَٰتٍۭ بِٱللَّهِ إِنَّهُۥ لَمِنَ ٱلصَّٰدِقِينَ 6  

5.  Save those who afterward repent and make amends. Then (for such) lo! Allah is Forgiving, Merciful.

6a.  As for those who accuse their wives but have no witnesses except themselves;
5.  ‘Illallaziina  taabuu  mim-  ba’-di  zaalika  wa  ‘aslahuu.  Fa-‘innAllaaha  Gafuurur-Rahiim.

6a.  Wallaziina  yarmuuna  ‘az-waajahum  wa  lam  yakul-lahum  shuhadaaa-‘u  ‘illaaa  ‘anfusuhum

Commentary

Yarmuuna – (those who accuse), this word has come out from ramiyun, actual meaning of which is “to shoot anything from distance, for example, an arrow with the bow etc. by which a person is wounded”. Abusing, accusing or using disagreeable words against someone is also like shooting him with arrow. If a person said about any other before the people that he/she has committed adultery, then that person injured his/her honor and fame as much that its wound will be deeper than the wound of the arrow. According to Law; it is called “Qazf” (a publication to defame someone), and if the blamer does not produce four witnesses, then his/her punishment will be scourging with eighty stripes, which is called “Hadd Qazf” (Line of Libel).

It is incumbent on the mankind that he should never asperse any other; otherwise there is a threat of creating a great disturbance. Above mentioned punishment is against common forms of Qazf (Libel). But if a husband says something wrong concerning his wife, for example he says that she has committed adultery, then what should be done in this form?

According to common Law, he should produce four witnesses for proving his claim. If the reliable witnesses are produced and their testimony is accepted, then his wife will be punished by stoning, which is punishment for the honorable woman adulteress. But if the reliable witnesses are not available, even then the matter will not be left as it is, because after accusing own wife of adultery, mutual relations between husband and wife cannot remain pleasant. In this form there is commandment of “Li-‘aan” – (four times testimony and at fifth time, invoking the curse of Allah on him if he lies), which will be discussed in upcoming lessons.

Accusation without proof

وَٱلَّذِينَ يَرْمُونَٱلْمُحْصَنَٰتِ ثُمَّ لَمْ يَأْتُوا۟ بِأَرْبَعَةِ شُهَدَآءَ فَٱجْلِدُوهُمْ ثَمَٰنِينَ جَلْدَةً وَلَا تَقْبَلُوا۟ لَهُمْ شَهَٰدَةً أَبَدًا وَأُو۟لَٰٓئِكَ هُمُ ٱلْفَٰسِقُونَ 4  

4.  And those who accuse honourable women but bring not four witnesses, scourge them (with) eighty stripes and never (afterward) accept their testimony; and they indeed are evildoers -
4.  Wallaziina  yarmuunal-muh-sanaati  summa  lam  ya’-tuu  bi-arba-‘ati  shuhadaaa-‘a  fajli-duuhum  samaaniina  jaldatanw-wa  laa  taqbaluu  lahum  shahaa-datan  ‘abadaa.  Wa  ‘ulaaa-‘ika  humul-faasiquun.

Commentary

‘Al-muh-sanaati – (legally married women, lawful wives), this word has passed in Suratun-Nisaa’. Here it aims “honorable women”, but for the married men is also the same commandment.

It is first duty of the mankind that they should keep the society chaste. Society is not only the name of dwelling of the people collectively at one place, but to establish among them such relationship, by which the spirit of agreeing together is born. It is the congregational soul, influence of which, brings changes in the individuals. Therefore it is responsibility of every individual that they should save the society from wrong manners, so that among the people of the society, chaste and pure social spirit may be produced. In the previous verses, punishment of adultery was described because that is such evil which destroys the whole community.

In this verse, there is mention of accusing someone without proof. And it also is the matter by which discord is produced between mutual relationships and the society gets out of order. If a person says something wrong concerning any other and disgraces him/her, but for proving he/she may not produce four reliable witnesses before the Court, who should come out with the standard of testimony, then he/she will be scourged with eighty stripes and his/her testimony in any other matter will never be acceptable in future.

Such people who consider that vilifying others is a game, indeed they deserve to be called evildoers, because they violate the limits of the Religious Law.

After meditating in the above mentioned verse, this theory can be understood that why the word “Muhsin” is used for “the married man” and the word “Muhsinah” for “the married woman”? Muhsin means “maker of the safety fort around the woman” and Muhsinah is “the woman who takes shelter in that safety fort”. A strong indication exists in the name that the commandant of the fort i.e. “the man” is sole responsible of the safety fort, and the woman should not go out of her safety fort.

After that, if the married man violated the marriage-bed, he himself broke the safety fort. And if the married woman committed adultery, then she has gone out from the safety fort. Now these both persons are incurable affliction for the society and are like robbers. For them; only the word “offence” is not sufficient as a sin, but it is equal to act of murder - an adversary of the humanity.

After that in this verse, it has been indicated obviously that adultery after marriage is against the dignity of a Believer. It is the work of those immoral law-breakers who rob openly in the society or those who disbelieve in Allaah Almighty or after having belief they follow others or own wishes. Such people are humanity-breakers. Therefore there punishment cannot be ordinary, but the world should be purified even from their existence.

The people who think that punishment of stoning has not been mentioned in Holy Qur’an, so giving punishment of stoning to death to the “Muhsin” and “Muhsinah” is violation of the Commands of Holy Qur’an, they should bear in mind that evil of these impure acts has crossed the line of a crime. Those undefiled persons have understood this point after studying the Holy Qur’an, in which; badness of these evil deeds has been caused to understand by only powerful expressions and peculiar metaphors. As though, circumstances of such kind of evil doers are not able to be mentioned in clear words.

They judged from it that married adulterers and adulteresses are deadly poison for the society. Showing for them favor is opening the door of humanity’s destruction. Therefore they considered that the recompense mentioned in Torah against married adulterers and adulteresses was correct in all respect, which was ignored by the Jews. Not only this, but they denied of it entirely. They used to bring not the cases of their married adulterers and adulteresses unto their scholars; but bring unto the Messenger of Islam (grace, glory, blessings and peace be upon him), with the hope that he will save them from stoning to death by showing their favor. It was commanded to the Messenger (grace, glory, blessings and peace be upon him) in Holy Qur’an: Decide such cases of the Jews in accord with the Commandment of Torah. From the same, it was concluded that stoning to death is Law of Justice and it should be in force also in Islam.

Like this, mutual relationship of Believing man or woman is not correct with any idolater or idolatress, because several social complications arise due to it. The reason is that the standard of morality of the both is separate from each other. Therefore besides the fear of disputes between the twain and becoming of the life a burden, many difficulties concerning the descendants come before. It has been explained also in Chapter two. Marriage relation of believing man with idolatress or idolater’s such relation with believing woman is lawfully forbidden in Islam. However, if the nuptial knot of any adulterer is tied with any chaste woman or any chaste man with any adulteress, then its legal condition is that this case will be produced before the judiciary, and if they do not repent then they will be separated by the judiciary.

It is found from the above mentioned verse that possibility of adultery in Islamic Society is among the unmarried youngster male and female. Therefore, the punishment for its prevention has been prescribed in the verse before under reference. After marriage; there is no chance of fornication in Islamic Society. Therefore if married men and women are involved in adultery, then it can be a rare case. So, no limit of punishment in this regard has been mentioned clearly in Holy Qur’an, as limit of punishment concerning sodomy has not been described evidently, because any of these both sins is entirely against the morality and dignity of the Muslims. Evil of the both sins has been narrated clearly, but the punishment against each of both sins has been left upon the judgment of the Just Ruler.

Accordingly, such Just Rulers, in whose understanding and justice there is no doubt, have fixed the punishment of above mentioned both sins after proof that they should be slain by annoyance. Giving such kind of punishment has also been transcribed by reliable sources. Messenger of Allaah Almighty (grace, glory, blessings and peace be upon him) himself enforced the punishment of stoning to death, for married man and woman after lawful proof of their sin, according to the commandment of Torah. After that, Omar (may Allaah be pleased with him) and other rulers; not only gave judgment of slaying to the criminal of sodomy, married adulterer and adulteress, but they issued instructions practically in this regard. Reason of this severe punishment is that destroying the thing utterly, which is an adversary for the humanity and enemy of the modesty, can keep the society purified from wrong deeds. There is no need of so-called remission, mercy or kindness in keeping the society purified.
