Chapter “’Al-‘Ahzaab” - (The Clans) - 33
‘A-‘uu-zu Billaahi minash-Shay-taanir- Rajiim.
(I seek refuge in Allaah
from Satan the outcast)

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِذَا نَكَحْتُمُ ٱلْمُؤْمِنَٰتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِن قَبْلِ أَن تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا 49
49. O ye who believe!
If ye wed believing women and divorce them before ye have touched them, then
there is no period that ye should reckon. But content them and release them
handsomely.

Yaaa-‘ayyuhallaziina
‘aamanuuu ‘izaa nakah-tumul-Mu’-minaati summa
tallaqtu-muuhunna min qabli
‘an tamassuu-hunna famaa
lakum ‘alayhinna min
‘iddatin ta’-tadduuna-haa. Famatti-‘uuhunna wa
sarrihuu-hunna saraahan jamiilaa.

Commentary
In the course of describing concerning the
wives (May Allaah be pleased with them) of the Messenger (grace, glory,
blessings and peace be upon him), common Muslim women have been instructed, and
wedding with the divorced wife of the adopted son has been made lawful. In this
regard, one more common instruction has been given.
It has been commanded in this verse: If a man
weds a woman and after marriage he divorces his wife without touching her due
to any reason, then in this form, neither there is any waiting period for
the divorced woman and nor the man is liable to pay her full dowry.
It is commanded: The people who have believed, they should
listen that when any man of them married a Muslim woman, then both - husband
and wife did not yet meet with each other in privacy and such cause happened
that he had to divorce his wife before touching, then it would not be incumbent
on the man that he should cause to complete the waiting period from the
divorced woman. She can marry any other man as soon as her husband divorced her.
If the dowry was fixed then the man who divorced, would have to pay half of the
dowry, as it was explained in Suratul-Baqarah (Chapter -2).
But if the dowry was not determined, then he would have to pay
nothing. However, he should release her with good manner by giving her
something, for example a set of clothes etc. according to his status for
satisfying her. This is a general order for the
Messenger (grace, glory, blessings and peace be upon him) in which entire
Muslims are included.
